General terms and conditions

Article 1 — Identity of the service provider

MeerwaardeTool.be is a web application offered by ID Holding, with registered office at Stokerijstraat 29D/7, 2110 Wijnegem, Belgium, registered with the Belgian Crossroads Bank for Enterprises under number BE0690.712.650 (hereinafter “we”, “us” or “the provider”). Article 2 — Scope

These general terms and conditions apply to any use of the MeerwaardeTool.be web application and to every agreement concluded between the provider and the user. By creating an account and using the application, the user accepts these general terms and conditions in full and without reservation. If the user does not agree, they must not use the application. The application provides informational calculations only. It does not constitute tax, legal or financial advice and does not replace consulting a qualified tax advisor or accountant.

Article 3 — Access and registration

To use the application, the user must create an account with a valid email address and password, or via their Google account. The user is responsible for keeping their login credentials confidential and for all activity that takes place via their account. The provider must be notified immediately of any unauthorised use. The provider reserves the right to suspend or delete accounts in the event of misuse or non-compliance with these terms.

Article 4 — Subscription and price

4.1 Paid subscription The MeerwaardeTool.be subscription costs €39.00 per year, including VAT. This amount is due upon subscribing and is then charged annually via the payment method provided by the user. The user gains immediate access to all features of the application after payment. 4.2 Automatic renewal The subscription is automatically renewed for a period of one year, unless the user cancels the subscription before the end of the current period via the account settings. 4.3 Price changes The provider reserves the right to change the subscription price. Price changes are communicated by email at least 30 days in advance. If the user does not agree, they may cancel the subscription before the effective date of the new price.

Article 5 — Right of withdrawal and refund policy

No refund: All payments for the MeerwaardeTool.be subscription are final and non-refundable, except as expressly provided in this article or as required by mandatory Belgian consumer law. 5.1 Right of withdrawal Performance of the service begins immediately after payment, with the user’s express consent. As a result, the statutory 14-day right of withdrawal for distance contracts lapses. 5.2 No refund Once the right of withdrawal has lapsed as set out in article 5.1, and upon each automatic renewal of the subscription, no refunds are granted, including in the event of partial use of the subscription or early cancellation. The user retains access to the application until the end of the period already paid for. 5.3 Exception In the event of technically proven complete unavailability of the application for more than 30 consecutive days, the user retains the right to a proportionate refund for the period of unavailability.

Article 6 — Cancellation

The user may cancel the subscription at any time via the account settings. The cancellation takes effect at the end of the current subscription period. After cancellation, access to the application remains active until the end of the paid period. The provider may terminate the subscription immediately in the event of serious misuse, non-payment or breach of these general terms and conditions, without any refund of amounts already paid.

Article 7 — No tax advice

The calculations and simulations generated by the application are purely informational and based on the data entered by the user and the legal texts available at that time. They do not constitute tax, legal or financial advice. The provider expressly recommends that the user consult a qualified tax advisor or accountant for their final tax return. The final return and its accuracy remain the sole responsibility of the user.

Article 8 — Limitation of liability

The provider strives for correct and up-to-date calculations but cannot guarantee their absolute accuracy. The capital gains tax is new legislation that may still be subject to interpretations, circulars and amendments. The provider is not liable for: • Errors or inaccuracies in the tax calculations • Decisions made on the basis of the application’s results • Damage arising from the use or temporary unavailability of the application • Loss of data due to technical failures or force majeure The provider’s total liability is in any event limited to the amount the user paid for the subscription in the 12 months preceding the event giving rise to the damage.

Article 9 — User obligations

The user undertakes to: • Enter correct and complete data • Not share their account details with third parties • Not use the application for unlawful purposes • Not attempt to hack, misuse or overload the application • Not use automated systems to access the application without express permission

Article 10 — Intellectual property

All content, code, algorithms and functionality of MeerwaardeTool.be are the property of the provider or its licensors and are protected by intellectual property law. The user obtains only a non-exclusive, non-transferable right of use for personal and non-commercial use. It is not permitted to copy, reverse-engineer, distribute or create derivative works of the application without express written permission.

Article 11 — Availability

The provider strives for the highest possible availability of the application but does not guarantee uninterrupted operation. Scheduled maintenance is communicated in advance where possible. The provider reserves the right to suspend or permanently discontinue the application, with a prior notice period of at least 30 days in the event of permanent discontinuation.

Article 12 — Changes to the terms

The provider may amend these general terms and conditions at any time. In the event of material changes, the user is informed by email at least 30 days in advance. Continued use of the application after that period constitutes acceptance of the amended terms.

Article 13 — Governing law and competent court

These general terms and conditions are governed by Belgian law. In the event of disputes, the courts of the judicial district of Antwerp have exclusive jurisdiction. The provider encourages the user to first make contact via info@meerwaardetool.be in the event of a problem, so that an amicable solution can be sought.
